1.1 In this By-law:
a) “angle parking” means that, where angle parking is permitted, no person shall park a vehicle except at the angle indicated by authorized markings or signs and so that the front end of the vehicle is nearest to the edge of the roadway.
b) “authorized emergency vehicle” means a vehicle as defined in subsection 144(1) of the Highway Traffic Act.
c) “boulevard” means that portion of highway, other than a sidewalk and/or entrance from a road to a private road, driveway or lane, between the curb lines or the lateral lines of a roadway and the adjacent property line.
d) “by-law” means a by-law of The Corporation of the Town of Bradford West Gwillimbury.
e) “commercial motor vehicle” means a motor vehicle having permanently attached thereto a truck or delivery body and includes ambulances, hearses, fire apparatus, buses and tractors used for hauling purposes on the highways.
f) "community safety zone" shall mean sections of roadway where public safety is of special concern. Community Safety Zones may include roadways near schools, day care centres, playgrounds, parks, hospitals, senior citizen residences and may also be used for collision prone areas within a community as listed in Schedule E to this by-law;
g) “Corporation” means The Corporation of the Town of Bradford West Gwillimbury.
h) “Council” means the Council of the Corporation.
i) “crosswalk” means that part of a highway at an intersection that is included within the connections of the lateral lines of the sidewalks on opposite sides of the highway measured from the curbs or, in the absence of curbs, from the edges of the traveled portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by signs or signals or by lines or other markings on the surface.
j) “curb” means the edge of a traveled portion of the highway.
k) “designated disabled person parking space” means a parking space designated under this by-law for the exclusive use of a vehicle displaying a disabled person parking permit in accordance with the requirements of the Highway Traffic Act, the regulations made thereunder and this By-law.
l) “disabled person” means an individual who is unable to walk unassisted for more than 200 metres without great difficulty or danger to his or her health or safety and who has been certified as such by a person legally qualified to practice in Canada as a physician, chiropractor, occupational therapist, osteopath or physiotherapist.
m) “disabled person parking permit” means a disabled person parking permit issued under section 26 of the Highway Traffic Act, and Regulation 581 made thereunder, or a currently valid permit, number plate or other marker or device bearing the international symbol of access for the disabled and issued by another jurisdiction.
n) “fire route” means an access route for fire department vehicles to gain access to a building or a property which may be located upon a highway, public parking lot or private property. (Deleted by By-law 2025-35)
o) “gross weight” means the combined weight of vehicle and load.
p) “heavy trucks” means any commercial motor vehicle having a registered gross weight or actual gross weight in excess of four thousand, six hundred (4,600) kilograms, but does not include ambulances, transit buses, school buses, police services vehicles, fire apparatus, or vehicles owned by or operated for the Corporation of the Town Bradford West Gwillimbury, the County of Simcoe, the Ministry of Transportation (Ontario), or any utility vehicle, farm plated equipment and vehicles, vehicles making a local delivery. q) “highway” means a common and public highway, street, avenue, parkway, driveway, square, place, bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of vehicles and includes the area between the lateral property lines thereof.
r) “intersection” means the area within the lateral curb lines or, if none, then of the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other (as is the case with a “T” intersection).
s) “Officer” means a municipal law enforcement officer employed by the Town, a police officer, the Fire Chief or his designate employed by the Town and any agent appointed by the Town, in accordance with section 1(1)(e) of the Provincial Offences Act, R.S.O. 1990, c. P. 33, to enforce municipal by-laws; (Amended by By-law 2022-73)
t) “motor vehicle” means an automobile, motorcycle, motor assisted bicycle, e-bike, and any other vehicle propelled or driven other than by muscular power, but does not include a motor vehicle running upon rails, or a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry or road building machine within the meaning of the Highway Traffic Act.
u) “municipal or private property” means any open area or portion of a structure, other than a highway, intended for the temporary parking of vehicles and on which there are designated parking spaces, whether their use involves the payment of a fee or otherwise.
v) “one-way highway” means a highway upon which vehicular traffic is limited to movement in one direction.
w) “owner” when used in connection with real property means: in the case of a property upon which there is a condominium, the corporation incorporated under the Condominium Act, 1998, S.O. 1998, C. 19, as amended, the Condominium Act, for that condominium; or otherwise the person(s) shown as the owner of the property on the last revised assessment roll of the Corporation.
x) “parallel parking” means that, where parallel parking is permitted, no person shall park a vehicle except parallel to the curb. Cars parked in parallel are in one line parallel to the curb, with the front bumper of each car facing the back bumper of an adjacent one and with the right tires next to the curb.
y) “park or parking” means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers.
z) “parking space” means a portion of the surface of a highway, municipal or private property designated by suitable markings, the use of which for the parking of a vehicle is controlled and regulated.
aa) “parking ticket” means the certificate of parking infraction and parking infraction notice prescribed under section 20 of the Provincial Offences Act R.S.O. 1990, c. P.33, as amended.
bb) “pedestrian” includes a person on foot, a person in a wheelchair and children in wheeled carriages.
cc) “person” includes an individual, corporation, firm or agent thereof.
dd) “private roadway” means any private road, lane, ramp or other means of vehicular access to or egress from a property, building or structure, and it may include part of a parking lot.
ee) “public parking facility” means a parking lot or other parking facilities on private property or on property owned or occupied by the Corporation or any local board thereof, to which the public has access, whether on payment of a fee or otherwise.
ff) “residential zone” as defined in the Town’s Zoning By-law 2010-050, as amended.
gg) “roadway” means the part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include the shoulder, and where a highway includes two or more separate roadways the term "roadway" refers to any one roadway separately and not to all of the roadways collectively.
hh) “school bus” means a bus used for the transportation of children to and from school that bears on the rear thereof the words “Do not pass when signals flashing”; is equipped with two (2) red signal lights on the rear thereof and two (2) red signal lights on the front thereof; and is painted chrome yellow with black lettering and trim.
ii) “school bus loading zone” means an area on a highway or on private property as designated by Schedule B of this By-law where signs are on display indicating that parking is prohibited in order to provide school buses with the facility to load or discharge passengers.
jj) “school crossing guard” means a person employed by the Corporation to direct the movement of children crossing a highway.
kk) “sidewalk” means that portion of a highway between the curb line or the lateral line of a roadway and the adjacent property line intended for the use of pedestrians.
ll) “sign” means an approved sign in accordance with the Highway Traffic Act, Reg. 615 or a symbolic sign approved by the Corporation.
mm) “signalized intersection” means an intersection that is controlled by traffic control signals.
nn) “stand or standing” means the halting of a vehicle, whether occupied or not.
oo) “stop” when required, means a complete cessation of movement.
pp) “stop or stopping” means any stopping of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a constable or other police officer or of a traffic control sign or signal.
qq) “Town” means the Corporation, including its geographic area.
rr) “traffic” includes pedestrians, ridden animals, vehicles and other conveyances either singly or together while using any highway for the purpose of travel.
ss) “traffic control device” means any sign, highway, curb or sidewalk marking, or other device erected or placed under the authority of the municipal Council for the purpose of regulating traffic.
tt) “traffic control signal” means that part of a traffic control signal system that consists of one set of no less than three (3) coloured lenses, red, amber and green, mounted on a frame and commonly referred to as a signal head.
uu) “traffic sign” means any device manually, electrically or mechanically operated for the regulation of traffic.
vv) “trailway” means a recreational trail that is provided by the Corporation for use by pedestrians, cyclists and other users other than persons on motorized vehicles and horses, and which is located within road allowances, or other lands owned or occupied by the Corporation.
ww) “Treasurer” means the Treasurer of the Corporation.
xx) “u-turn” means that no owner or operator of a vehicle upon a highway shall turn a vehicle continuously so as to proceed in the opposite direction.
yy) “vehicle” includes a motor vehicle, trailer, traction engine, farm tractor, road building machine and any vehicle drawn, propelled, or driven by any kind of power, including muscular power, but does not include a motorized snow vehicle or a street car.
zz) “walkway” means any portion of a highway so designated as a walkway which shall also mean pathway or footpath by this By-law and intended for the use of pedestrians.
aaa) “wheelchair” means a chair mounted on wheels driven by muscular or any other kind of power and used for the carriage of a person who has a physical disability or medical condition.
bbb) “local delivery” means any commercial motor vehicle making a delivery to or a collection from a specific address that is prohibited to heavy truck traffic. (Added by By-law 2016-13)
ccc) “driveway” means the land on a highway which provides vehicular access from a roadway to a laneway or parking area on adjacent land. (Added by By-law 2016-86)
ddd) “traffic calming device” means any device or technique approved under the authority of municipal Council on or next to a roadway that is to slow or restrict traffic and may include: flexible bollards, curb extensions, speed cushions, island medians, curb radius reductions, raised intersections, raised crosswalks, traffic circles, directional and raised medians, diverters, speed humps and full closures. eee) “unauthorized area” means any front yard, exterior side yard or interior side yard as defined under the Town’s Zoning By-law, as amended, unless otherwise expressly permitted. (Added by By-law 2019-89)
fff) “Administrative Monetary Penalty By-law” means By-law 2022-56 of the Town, as amended from time to time, or any successor thereof; (Added by By-law 2022-73)
ggg) “Designated Provision” means any section of this By-law designated in accordance with Section 9.4; (Added by By-law 2022-73)
hhh) “O. Reg. 333/07” means Ontario Regulation 333/07, made under the Municipal Act, 2001, S.O. 2001, c. 25, as amended from time to time or any successor thereof; (Added by By-law 2022-73)
