Being a By-law to regulate the operation of motorized snow vehicles.


 

WHEREAS Section 7, Subsection 2 of the Motorized Snow Vehicles Act, R.S.O. 1990, Chapter M.44 provides that the Council of a local municipality may pass by-laws regulating, governing or prohibiting the operation of motorized snow vehicles within the municipality including any highways therein or any part or parts thereof;

AND WHEREAS Bill 51, An Act respecting the Restructuring of the County of Simcoe received Royal Assent on December 14, 1993;

AND WHEREAS the Council of the Corporation of the Town of Bradford West Gwillimbury deems it necessary and expedient to pass a By-Law to regulate the operation of motorized snow vehicles for the protection of highways and citizens;

NOW THEREFORE the Council of the Corporation of the Town of Bradford West Gwillimbury enacts as follows:

a)    "Highway" includes a common and. public highway, street, avenue, parkway, driveway, square, place,
        bridge, viaduct or trestle, designed and intended for, or used by, the general public for the passage of
        vehicles.

b)    "Motorized snow vehicle" means a self-propelled vehicle designed to be driven primarily on snow.

c)    "Police" means the Bradford West Gwillimbury Police Service.

d)    "Person" means a natural person.

e)    "Serviced roadway" means the part of highway that is improved, designed or ordinarily used for vehicular
       traffic, and includes the ploughed portion of the shoulder, and, where a highway includes two (2) or more
       separate serviced roadways, the term "serviced roadway" refers to any one (1) serviced roadway
       separately and not to all of the serviced roadways collectively.

f)    Sidewalk" shall include any sidewalk, track or path used by or set apart for the use of pedestrians and
       forming part of any public road allowance, bridge, boulevard or other means or public travel.

g)   "Town" means the Corporation of the Town of Bradford West Gwillimbury.  

The owner of a motorized snow vehicle shall obtain a permit for the motorized snow vehicle issued or validated by the Ministry of Transportation.

1)    No person shall operate a motorized snow vehicle in the Town during any day between the hours of 11:00 p.m. to 7:00 a.m. in a residential subdivision.

2)    No person shall drive a motorized snow vehicle upon a sidewalk in the Town except for the purpose of directly crossing such sidewalk.

3)    No person shall operate a motorized snow vehicle upon any privately owned property in the Town without the express written permission of the owner of the property.

4)    No person shall operate a motorized snow vehicle on any Town parklands and properties 

Any of the provisions of this By-law may be waived when an emergency exists for travel purposes. 

No person shall drive a motorized snow vehicle across a serviced roadway except at an angle of approximately 90 degrees to the direction of the serviced roadway.

No person shall drive a motorized snow vehicle at a greater rate of speed than 20 kilometers per hour, on a highway where the speed limit established pursuant to the Highway Traffic Act is 50 kilometres per hour or less; or 

50 kilometres per hour, On any highway which is open to motor vehicle traffic, where the speed limit established pursuant to the Highway Traffic Act is greater than 50 kilometres per hour.

Every person who contravene any provision of this by-law is guilty of an offence and liable upon conviction to a penalty not exceeding $5,000.00, exclusive of costs and the provisions of this Provincial Offences Act, R.S.O. 1990, C. P. 33, as amended, shall apply to the said fine.

That By-laws 2242 and 88-20 of the former Town of Bradford are hereby repealed.

That By-law 94-004 is hereby repealed.

This By-law shall be cited as the Motorized Snow Vehicles By-law.

This By-law shall come into full force and effect when signs are erected in accordance with the regulations.
